The crime of sex slavery and the importance of International Criminal Court’ permanent character

International Humanitarian Law prohibits sexual violence in armed conflict. However, disrespect for regulations is routine in conflicts, requiring repression of perpetrators of crimes and reparation for victims. The criminal war courts responsible for judging leaders in armed disputes often failed to recognize the existence and impact of crimes of a sexual nature on the lives of countless victims, mostly women. In this study, through theoretical research in doctrinal sources and in the face of the deductive method, the importance of the International Criminal Court, a permanent criminal war court, was investigated for the judgment of the crime of sexual slavery in the context of armed conflicts. The presence of a strong international position to judge such crimes is of vital importance in building parastatal cooperation concerned with bringing justice to those in need, preventing the mistakes committed with “comfort women” from being repeated and those responsible for the cruelties perpetuated cease to be judged. In conclusion, it was found that, despite the criticisms leveled at the Court's performance, the prospect of permanently processing and judging cases by a specialized Court is commendable, in addition to being essential for victims of sexual slavery to be properly compensated.
