Abstract

In a world shaped simultaneously by globalization and fragmentation, wars do not remain isolated from any foreign involvement or confined to the territory of a single state. On the contrary, several of them begin internally and, gradually, spread out in different degrees and nature. In fact, the law of war reveals one of two legal categories: a non-international or international armed conflict. In both situations, combatants and civilians must be protected by rules that minimally restrict horror and barbarity. This is the purpose of the Geneva Conventions, the hard core of International Humanitarian Law (IHL). This article will analyze the sources and principles of IHL, as well as the concrete impact of its application in the attack on the village of Nangar Khel during the war in Afghanistan in 2005.
