Abstract

This article was developed based on the participation of this magistrate, at the invitation of the Military Public Prosecutor's Office, in partnership with the Universitá di Roma Tre and the Procura Generale Militare presso la Corte do Cassazione, in the Seminar “Comparative Military Legal System Brazil Italy”, from April 2 to 5, 2024, in the city of Rome, Italy. Thus, it seeks to explain the main similarities and differences between the Brazilian Military Penal Code and the Codice Penale Militare di Pace. Based on the analysis of the concept of military crime from the perspective of Comparative Law and some criminal institutes, military crimes contained in Brazilian legislation and in Italian legislation are analyzed. Through this analysis, it is possible to reach the conclusion that there are major differences between the two countries, with regard to Military Criminal Law.
