The Impact of the Inter-American Court of Human Rights on the Domestic Law of States: The Cases of Brazil and Costa Rica

Abstract

The Pact of San José, drafted in the capital of Costa Rica and formally known as the American Convention on Human Rights, is an international treaty adopted in 1969, in which the signatory countries, including Brazil, committed to guaranteeing and protecting a series of human rights. Brazil only ratified the Pact in 1992, and its impact on the domestic legal system is quite significant, directly influencing the protection of constitutionally enshrined fundamental rights. This essay aims to analyze how the Pact of San José has impacted the domestic law and jurisprudence of Brazil and Costa Rica, especially in light of the following commemorative dates in 2024, considering the 75th anniversary of the Geneva Conventions, the 55th anniversary of the Pact of San José, and the 45th anniversary of the Inter-American Court of Human Rights.

Ambassador Extraordinary and Plenipotentiary of Costa Rica to the Federative Republic of Brazil since July 2019. Lawyer and Notary (UCR), with a Master’s degree in International Protection of Human Rights (Utrecht University) and a Master’s degree in International Economic Policy and Development (Erasmus University Rotterdam), both in the Netherlands. He was Counselor and Consul at the Embassy of Costa Rica in the Netherlands and Minister Counselor of the Permanent Mission of Costa Rica to the United Nations Office at Geneva. Member of the Costa Rican Delegation in the Case of Navigation Rights on the San Juan River (Costa Rica v. Nicaragua Case) and of the Presidency team of the Treaty on the Prohibition of Nuclear Weapons. Head of the Department of Multilateral Policy. President of the National Commission for International Humanitarian Law. Former President of the Costa Rican Association of Career Diplomats. University professor.
