The Impact of the Inter-American Court of Human Rights on the Domestic Law of States: The Cases of Brazil and Costa Rica

Abstract

The Pact of San José, drafted in the capital of Costa Rica and formally known as the American Convention on Human Rights, is an international treaty adopted in 1969, in which the signatory countries, including Brazil, committed to guaranteeing and protecting a series of human rights. Brazil only ratified the Pact in 1992, and its impact on the domestic legal system is quite significant, directly influencing the protection of constitutionally enshrined fundamental rights. This essay aims to analyze how the Pact of San José has impacted the domestic law and jurisprudence of Brazil and Costa Rica, especially in light of the following commemorative dates in 2024, considering the 75th anniversary of the Geneva Conventions, the 55th anniversary of the Pact of San José, and the 45th anniversary of the Inter-American Court of Human Rights.
