Violence against a Superior Resulting in Death: Is Criminal Progression Possible?

This article analyzes the legal nature of the result of death in the crime of violence against a superior (Article 157 of the Military Penal Code), discussing the possibility of applying the institutes of criminal progression and concurrence of crimes. Based on a critical review of military penal doctrine and jurisprudence, it explores the principles of consuntion, the concurrence of crimes, and the specificities of violent crimes provided for in the Military Penal Code. The conclusion is that the result of death in the crime of violence against a superior constitutes a specific qualifier of the offense, not a case of criminal progression or concurrence of crimes, thereby reinforcing the protection of the constitutional principles of hierarchy and discipline in the Armed Forces.
