Analysis of the Military Crime of Undue Publication or Criticism in light of ADPF 475

This article explores, through bibliographic review, the facets of the military crime of publication or undue criticism (Art. 166 CPM), in light of the current Brazilian society about self-exposure on social networks and the parameters brought by ADPF 475, judged by the Federal Supreme Court. The research aimed to contribute to the debate advanced by the Brazilian supreme court, taking the trial in question as a premise, in order to strengthen the legal treatment regarding military criminal conduct in the abstract. And, finally, it was concluded that the analysis of violation of legal rights and, subsequently, the need for a suitable criminal response, must take into account the criteria set out in Article 13, 1, paragraphs “a” and “b”, of the American Convention on Human Rights, in order to bring greater legal certainty in the analysis of the aforementioned military crime.
