Abstract

Law 14.688/23 established a reform/update of the Military Criminal Code, modernizing terms and expressions, repealing articles and seeking to make the criminal legislation compatible with the current constitutional order. In this context, the new law expressly repeals art. 21 of the military penal code, which defines who is similar. The aim of this paper is to examine the historical context of the figure of akin, as well as to present understandings of the legal nature of this institute and the (im)possibilities of its application in the field of military law.
