Abstract

This article is the result of reflections provoked as a result of participation in the 1st Comparative Military Legal System Seminar Brazil and Italy, held in Rome/Italy, between April 2nd and 5th, 2024, which was attended by magistrates and members of the Military Public Ministry of both countries. The exchange of experiences with the European country allowed us to seek knowledge of another legislative reality, in order to compare it with the national order, leading to research on the application of war legislation by a country that has a history closer to the great armed conflicts occurring around the world, such as the two World Wars. As a result, participation in operations such as Enduring Freedom also led Italy to update its Military War Penal Code, with a view to adapting it to the commandments of International Humanitarian Law.
