The civil liability of the State is a matter of great importance these days, and liability arising from the death of a prisoner in custody in prisons is a relevant issue, especially after recent decisions of the Supreme Court and the Superior Court of Justice, recognizing the objective civil liability in this regard. Add the responsibility of the Commander of Military Organization, who repeatedly faces issues foreign to the performance of the Armed Forces. Therefore, the action of the Public Prosecution Service and the Judiciary through the Prison Inspections is essential. This article aims to analyze this responsibility, addressing both the death resulting from commissive conduct and resulting from state omission, the possible causes of exclusion as well as the measures to be taken by the Government to prevent these deaths.
