Military crimes by extension in the light of Federal Constitution of 1988

With the advent of Law 13.491/2017, began debate on the academic world and the scope. The new law changed the art. 9º of the Military Penal Code, resulting in the expansion of military crimes and the competence of the Military Justice. The new military crimes that occurred with the legislative change were classified as “military crimes by extension”, denomination by Ronaldo João Roth. The present work aims to know about the new category of military crimes, through the analysis of the classic and modern doctrine on a thematic. Therefore, It was mapped, based on military data of extension and its analysis in light of the Federal Constitution. The constitutional acceptance of the new category of military crimes is concluded and it is necessary to have a uniformity understanding through jurisprudence.
