The Brazilian State was sentenced on March 15, 2018 by the Inter- -American Court of Human Rights (IACHR), which adjudicated the Vladimir Herzog case and others vs. Brazil. The facts refer to the death of the journalist Vladimir Herzog, which took place within the DOI-CODI, on October 25, 1975, under the aegis of the military regime. The purpose of this article is to study the chapter of the sentence regarding the obligation of the Brazilian State to reopen the investigation and the criminal procedure and identify the Brazilian justice competent for eventual resumption of criminal prosecution. It also intends to present a history of the Federal Military Justice and of the Military Public Prosecution and to analyze the criminal responsibility of the agents before the institutes of amnesty and the statute of limitation.
