Abstract

Article 144 of 1988 Constitution of the Federative Republic of Brazil sets the military police and the fire brigade as “auxiliary armed forces” and “army reserves”. However, it is important to analyze the meaning of these legal terms. So, it is necessary to perform an evolutionary and historical analysis of those legal terms as well as of the functions of those state institutions, based on Brazilian legal system. From this analysis, it is necessary to verify the current definition of those legal terms applied to military police and fire brigade and their factual consequences.
