This work aims to show the facts that occurred on April 7th, 2019, in front of the Minhocão, in the Guadalupe neighborhood, in the city of Rio Janeiro, in which two civilians died and one was wounded, due to shots fired by army soldiers. It aims to present and discuss legal issues from a concrete historical case, emphasizing the theses used by legal practitioners who acted in a process judged at first instance in the 1st Audit of the Military Justice of the Union of the 1st Military Judicial Circuit. The conclusion is that the defense based its thesis exclusively on testimonies of witnesses who did not witness the facts; in versions of the accused; and in unproven scientific studies.
