The metaphor of the Three Block War and the Principle of Proportionality

It briefly reviews the generational approach to wars, characterizing contemporary conflicts as violent phenomena in scenarios of diffuse, volatile and uncertain conformation. It seeks to outline the legal frameworks applicable to situations of armed conflict (military paradigm of the use of force) and to other situations of violence (under the paradigm of the use of force to enforce law and order), establishing, respectively, International Humanitarian Law and International Human Rights Law as guidelines for the conduct of managers of armed violence. It recalls the role of fundamental principles as sources of law, bringing to the center of the argument the relevance of the principle of proportionality as an inducer of the reasonable use of force along the spectrum of conflicts. It breaks down the principle of proportionality into its constituent elements, seeking to establish a point of convergence that serves as a reference for the military commander in operations of an ambivalent or complex nature (war and non-war).
